1. Introduction

These Terms and Conditions govern the sale and supply of goods by Internet Retail Solutions Ltd through the Poles2u.com website. Each order placed by you will constitute a contract between you and Internet Retail Solutions in accordance with these Terms and Conditions to the exclusion of all other terms and conditions. Your attention is drawn to paragraph 11 regarding Limitation of Liability.

 

2. Internet Retail Solutions Contract

Our legally binding contract only starts as of when Internet Retail Solutions receive the payment in full for the goods purchased. Your payment of the price for the goods represents an offer on your part to purchase the goods, which will be accepted to us when we send to you an email that the goods have been sent to you.  Our acceptance of your order brings into existence a legally binding contract between us.

 

3. Pricing

The prices for goods are as specified on the Website. For all goods ordered, the total price payable including all applicable taxes will be shown at the time of order on the order confirmation page of the Website. Prices may change and the applicable price is that shown on the day which your order is placed.

 

 

3.1

If an additional delivery charge is payable in respect of deliveries made to locations within the UK or if there is any change in delivery cost we will notify you via phone or email to confirm with you that you want us to proceed with the order at the additional delivery cost.

3.2

Deliveries outside of the UK will only be made once authorized by Internet Retail Solutions and may be subject to an additional cost of which you will be notified when you make your order. If a delivery is required outside of the UK please contact us via email at info@poles2u.com before placing your order. If any additional delivery cost is chargeable, we will contact you by email or phone before we process your order.

3.3

Subject to clause 7. Once your order has been accepted by Internet Retail Solutions we will charge your debit or credit card for the full order payment and any additional delivery cost subject to clause 3.1. This will be done as soon as the order is accepted or as reasonably workable subsequently. We will notify you in the confirmation of your order of the approximate date of the goods delivery which will be made to the address shown in your order. 

4. Right For You to Cancel Your Contract

4.1

Subject to clause 4.2 You have the right to cancel your order for the goods within 14 days of the date of delivery of the order to you. No reason for order cancellation is needed nor will you incur a payment penalty. To cancel your order you must inform us by phone or email with your order number within the 14 day period.

4.2

You cannot cancel or change your order if the goods you have ordered are made to measure or custom made to your specifications or requirements as we are unable to resell them. Once we have accepted your ordered goods and they are entered into the order system or manufacturing process we are unable to acknowledge any changes to your goods ordered or cancel your goods ordered so please ensure all measurements are accurate and that all specifications are understood.  We cannot accept alterations, cancellations or liability for incorrect measurements or order details that have been supplied by yourself.  

4.3

Rights of Withdrawal - you have the right to withdraw from this contract within 14 days without giving any reason (with the exception of any made to measure or made to order items - please see terms in 4.2).

If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and ensure you take reasonable care whilst the item(s) are in your possession.  We will arrange for collection of the item(s) from your address on a suitable day between 9am and 5pm (collection within the UK will incur charges as outlined in our Returns Policy, additional charges may apply for non UK mainland). 

Upon having your goods collected you must ensure they are packaged adequately and safely, preferably in the same packaging they arrived to you in, ensuring you take reasonable care whilst the item(s) are in your possession.

If returning items using your own preferred courier / delivery service as opposed to our courier collection service we offer, we advise where possible to obtain proof of postage as well as using a fully insured and trackable service.  Any damages / loss when not using our courier service will be your responsibility to claim between yourself and the service you have used in sending the goods back.

You are responsible for paying any additional postage or shipping costs when returning item(s). 

We will not issue refunds for any items lost or stolen in transit, unless you are returning the goods using our dedicated courier. 

4.4

Subject to clause 4.5 the total cost of sending and returning the goods will be debited from your credit or debit card and the balance of the refundable money will be refunded within 14 days of us receiving the notification of cancellation of goods.  The refund must be processed back onto the original card however in the following circumstances a cheque may be sent to the billing address: 1) the original cardholder's account no longer exists, a cheque will be sent 2) the original card details have expired; once a new expires date can be provided it will go back onto the original card.

4.5

You must ensure the item is unused and in its original branded packaging and in a new and unused condition and that all manufacturers labels are still attached and the goods adequately packed to avoid damage on their return to us. On receipt of the returned goods a member of our team will inspect the goods. If the returned goods are deemed to be damaged or unsuitable for re-sale, the goods will be subject to a retention by us of 50% of the original order costs of the goods plus any additional cost we may incur if we have arranged the pickup and return of ordered goods from your pickup point. The balance of the refundable money will be paid within 14 days from us receiving the notification of cancellation. Your rights against us shall be limited to your rights to the return of your money. This does not affect your statutory rights.

4.6

If you have received the goods before you have cancelled your order under clauses 4.1 or 4.2 please contact us within 14 days via email or phone to advise that you wish to cancel your order.  We will give guidance on packaging goods and to arrange an appropriate time for the goods to be collected. If you choose to cancel your contract but the order has already been processed for delivery by us you must not unpack the goods upon receiving then and contact us as soon as possible.

4.7

Subject to the requirements of clause 4.2 and 4.5, upon the notification of cancellation of your order, any sum debited to us by credit or debit card will be refunded to you as soon as possible within 14 days of the order cancellation date. Provided the goods are made available for collection and received by us in accordance with clause 4.5 and not subject to misuse or negligence.  

 

5. Cancellation by us

5.1

Internet Retail Solutions reserve the right to cancel your order if:

5.1.1

We have inadequate stock resulting in us being unable to deliver your ordered goods.

5.1.2

An item or items ordered is listed with an incorrect price due to a typing error or an error in the pricing given to Internet Retail Solutions by the supplier.

5.2

If an order is cancelled by us we will inform you by email and will reimburse your account with the sum of your order debited by us from your credit or debit card within 14 days of your order.

 

6. Stock Shortages

If your ordered item is out of stock, we will contact you via email and advise the availability date.  We will place the goods on back order for you. 

 

7. Product Description & Measurement

7.1

All goods information and photography contained within the website is provided for illustrative purposes only, with information and descriptions being as accurate as possible. We endeavour to ensure the colour replication on our website is as close as possible.  However, there may be variations between the colours on screen and the actual product due to circumstances beyond our control, including, but not limited to, reproduction limitation, monitor resolution, monitor contrast and software configuration.

7.2

Certain products have to be made to measure. Wooden and metal poles, tracks and blinds that are made to measure products require very accurate measurements. To allow us to manufacture them correctly, it is your responsibility to provide us with the exact measurements. If the measurements you supply are not correct, it is not the fault of Internet Retail Solutions and no refund will be given. Internet Retail Solutions will not accept the return of any goods for the reason of incorrect measurements being provided. Please refer to our measuring guides for guidance on how to measure or call us for help and advice.

7.3

Every effort is made by Internet Retail Solutions to ensure that all goods sold and delivered to you match any description or sample sent or given to you. Any small variation or change in the colour, design, material or pattern between the description or sample and the goods delivered to you shall not entitle you to refuse the goods nor to declare any compensation for any such variation or change. Unless we are notified by e-mail or otherwise in writing within 7 days of the date of delivery of the goods they will be deemed to have been received by you undamaged and in good order. We give you the warranty that all goods will, in all material respects, comply with the description given about them on the website. No other warranty for the goods is given.

 

8. Delivering Your Goods

8.1

Internet Retail Solutions will deliver your goods to the delivery address submitted on your order form as soon as possible after your order is placed and processed. The estimated delivery time for goods and made to measure goods are quoted for in each order. Delivery times start from the day the order is processed or from the date any made to measure or made to order specifications are confirmed in writing. We normally aim to deliver goods within 2 working days, (except for made to measure goods for which please see specific goods for estimated delivery times.)

 8.3

Once goods have been delivered to you ownership of, and risk in the goods is passed to you. If you return the goods under clauses 4 or 9, ownership of, and the risk in the goods pass to Internet Retail Solutions upon receipt of the goods by us.

 

9. Defective Goods

9.1

Internet Retail Solutions warrant that all goods sold to you will, in all material respects be free from defects in workmanship and materials for a period of 12 months from the date the goods were delivered to you.

9.2

If a defect arises within the 12 month period, you are entitled to return the goods to us provided you have contacted us via email info@poles2u.com , telephone or written letter posted to Internet Retail Solutions, Rosetta Cottage, The Annexe, Sway Road, Brockenhurst, Hampshire, SO42 7SH giving us details of the defects If it appears in our reasonable opinion that the goods are defective we shall arrange:

9.2.1

For the defective goods to be collected via courier in order to repair or replace the goods and then deliver the goods back to you free of charge.

9.2.2

If upon inspection of the returned goods we decide in our reasonable opinion that the defect or defects have been caused by negligence, alteration/modification or misuse, we will inform you via phone or email. The total cost incurred of returning the goods will be debited from your credit or debit card within 30 days of us receiving the defective goods.

9.2.3

No liability under clause 9.2 shall arise unless delivery charge and price have been paid in its entirety on or before delivery.

9.2.4

If the goods are returned to us after 12 months from the date of delivery of the goods, or the goods are not defective, or they have modified, misused or subject to negligence, you will be accountable for the payment of our charges on a time and material cost basis in respect of any repair or repairs and for the collection and the return of the goods which we agree to carry out at your request. Internet Retail Solutions will be entitled to debit such a charge on the credit or debit card providing we notify you of the amount of any such charges before we commence with the repair.

9.2.5

Poles2u will not be liable in any way for any indirect or consequential loss or damage or loss of profits arising out of supply or failure not to supply the goods to you the consumer. All ordered goods must be inspected on delivery for:

9.2.6

Damages to goods in transit which includes any visible damage to outer carton /external packing.  It is your responsibility to make any reference to damaged packaging when you are signing for the goods.

9.2.7

Shortages.

9.2.8

Wrong goods delivered. If anything in clause 9.2.6 to 9.2.7 arises please notify us immediately via phone or email stating your name and original order number within 48 hours of receiving the goods. We are not liable for any external costs you may incur as a result of clauses 9.2.6 to 9.2.7. Depending on which is appropriate we will either replace the goods or refund the cost of the goods and collect the damaged or incorrectly delivered goods at our cost.

 

10. Acceptance of Order

All goods are subject to availability and an order will not constitute an agreement on our part to sell goods to you until it is accepted by us. You will be notified of our acceptance as soon as reasonably possible after your order has been received.

 

11. Limitation of Liability

In relation to the purchase of goods, we accept no liability for any indirect or consequential loss or damage or for any loss of data, profit, revenue or business (whether direct or indirect), however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of the Website or its contents other than as a direct result of purchasing our goods, we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of Internet Retail Solutions or our employees, agents or any other person. If we are liable to you for any reason, our liability will be limited to the amount paid by you for the goods concerned. This limit does not apply to any liability we may have for death or personal injury resulting from our negligence.

 

12. Intellectual Property Rights

All material on the Website is covered by copyright laws. Accordingly you should not copy, reproduce or retransmit any material from the Website apart from downloading the order form or other pages for your own personal use.

 

13. General Provisions

13.1

We may alter these Terms and Conditions from time to time and post the new version on the Website and that version will take effect immediately thereafter. You must check these Terms and Conditions on the Website regularly. They, together with the privacy policy, the order form and any instructions in that order form, will form the contract between us.

13.2

If any provision of these Terms and Conditions shall become illegal or enforceable for any reason whatsoever then these Terms and Conditions shall take effect as if such provision had been omitted and the remainder of the Terms and Conditions shall not be affected.

13.3

There Terms and Conditions and your use of the Website are governed by English law and you submit to the non-exclusive jurisdiction of the English court.

13.4

Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy.

14. Notices

All notices shall be given to us: By post to Internet Retail Solutions Limited; or By e-mail to info@poles2u.com And to you at either the e-mail or the postal address you provide on your order form. Notices will be deemed received when an e-mail is received in full (or on the next business day if it is received on a weekend or during a public holiday) or 3 days after the date of posting.
